Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioners, directing release upon furnishing bail bonds of Rs 10,000 each with two sureties.

Summary

The petitioners, Nikhil Kumar and Vishal, were arrested on 19 May 2025 after police intercepted a suspicious vehicle and recovered a pistol, live cartridges, a knife and mobile phones. They were charged under Sections 310(4), 310(5), 317(5) of the BNS and Sections 25(1‑B), 26 and 35 of the Arms Act. The petitioners contended that they were innocent, that no weapon was recovered from Vishal and only a knife from Nikhil, and that they have clean antecedents. The State opposed the bail application, citing the seriousness of the offences. The High Court, after considering the facts, directed that each petitioner be released on regular bail upon furnishing a bond of Rs 10,000 with two sureties, subject to cooperation with the trial. The interim application for bail was therefore allowed.
