Patna High Court

Md. SanaullahversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the petition for bail, granting it with conditions.

Summary

The petitioner, Md. Sanaullah, was arrested on 24-04-2025 in connection with a case filed under Sections 126(2), 115(2), 109 and 352 of the Bharatiya Nyay Sanhita, 2023, alleging that he assaulted the informant's husband with an iron rod, causing grievous injury that later resulted in death. The petitioner contended that the allegations were false, that the charge sheet was fabricated, and that the injury was initially reported as simple, not grievous. The prosecution opposed bail, emphasizing the seriousness of the offences, a specific allegation under Section 103, and the petitioner’s prior criminal antecedent. The High Court examined the nature of the charges, the period of custody, and the lack of a charge under Section 103, and considered the bail jurisprudence for non‑bailable offences. The Court granted bail on a bond of Rs. 10,000 with two sureties, subject to conditions of cooperation, presence in court, non‑tampering with evidence, and verification of antecedents. The order directed that the bail bond not be delayed for verification purposes.

Issues considered

  • Whether bail can be granted in a case involving offences under Sections 126(2), 115(2), 109, 352 and alleged Section 103 of the Bharatiya Nyay Sanhita, 2023.
  • Whether the petitioner’s alleged criminal antecedent and the seriousness of the alleged assault justify denial of bail.
