Suman SinghversusTHE UNION OF INDIA THROUGH THE CBI/SCB/PATNA

Decided

DISMISSED

Holding

A second anticipatory bail application is not maintainable and is dismissed.

Summary

The petitioner, Suman Singh, applied for anticipatory bail in a case involving alleged offences under several IPC sections, the Juvenile Justice Act, and the POCSO Act. Her earlier anticipatory bail application was rejected in 2021. She filed a second anticipatory bail application after three years, invoking a Supreme Court decision (G.R. Ananda Babu v. State of Tamil Nadu) that bars a second such application. The Patna High Court held that the second anticipatory bail request is not maintainable and dismissed it. The court directed the petitioner to surrender before the trial court on 16‑03‑2026 and seek regular bail, warning of arrest if she fails to comply. The order was to be communicated to the CBI Joint Directors in Patna and Ranchi.

Issues considered

  • Whether a second application for anticipatory bail is maintainable after a prior rejection
  • Whether the Supreme Court precedent in G.R. Ananda Babu v. State of Tamil Nadu precludes the second anticipatory bail
