The court held that the inconsistencies in the victim’s statement and the petitioner’s clean antecedents warranted the grant of regular bail subject to bond and sureties.
Summary
Munna Ravidas was arrested in connection with a rape case (Amdabad P.S. Case No. 261 of 2024) alleged under Sections 64, 352, 351(2), 3(5) of the Bihar Narcotic Substances Act and Section 4 of the POCSO Act. The petitioner claimed innocence, arguing that the victim’s statements were contradictory and that he has a clean antecedent, having been in custody for about nine months. The State opposed bail, citing the seriousness of the offences. The court examined the inconsistencies in the victim’s declaration and the petitioner’s long pre‑trial detention, and concluded that bail could be granted on condition of a bond and sureties. Accordingly, the court ordered the release of the petitioner on regular bail with a Rs.10,000 bond and two sureties, subject to his cooperation in the trial.
Issues considered
- Whether the petitioner is entitled to regular bail despite the gravity of the offences under the BNS Act and the POCSO Act
- Whether the inconsistencies in the victim’s statement justify granting bail
