BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond, sureties and a fixed deposit condition.

Summary

Jitendra Kumar applied for bail fearing arrest in a case (Warisanagar PS Case No. 103 of 2025) alleging defalcation of Rs.34,000 under several sections of the Bihar Negotiable Instruments Act. He contended that he was falsely implicated, the FIR was tampered, and he was willing to pay the amount without admitting guilt. The court, after hearing counsel, allowed the bail application. The petitioner was ordered to furnish a bail bond of Rs.10,000 with two sureties and to deposit Rs.34,000 as a fixed deposit, which would be released if he is acquitted. The bail was granted subject to the conditions of Section 438(2) of the CrPC and Section 482 of the BNSS.

Issues considered

  • Whether bail should be granted to the petitioner under Section 438(2) of the Code of Criminal Procedure, 1973 and Section 482 of the BNSS in view of the alleged offences.
  • Whether the petitioner’s claim of innocence and willingness to pay the alleged amount affect the bail decision.
