BAIL GRANTED

Holding

Bail was granted to the petitioners subject to a bond of Rs.10,000 with two sureties each.

Summary

The petitioners, a group of individuals from Ghorasahan, sought bail fearing arrest in a case (PS Case No. 510/2023) alleging offences under sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code. The prosecution alleged that the petitioners assaulted an informant and his sons and looted Rs.1.50 lakh from a grocery shop. The petitioners claimed innocence, asserting that the injuries were simple and that they were falsely implicated. The State opposed the bail application, emphasizing the seriousness of the accusations. The Court, after hearing both sides, considered the nature of the allegations and the petitioners' apprehension of arrest, and allowed bail on the condition of a Rs.10,000 bond with two sureties each, to be satisfied before the Sub‑Divisional Judicial Magistrate. The order thus granted bail to all petitioners.

Issues considered

  • Whether bail should be granted to the petitioners accused of offences under sections 341, 323, 324, 307, 504 and 506/34 of the IPC
  • Whether the petitioners' apprehension of arrest and claim of false implication merit bail
