BAIL REJECTED

Holding

The petition for pre‑arrest bail is dismissed.

Summary

Heera Lal Sahni petitioned for pre‑arrest bail after the police registered a case alleging he shot his mother, Sanju Devi, during a domestic dispute. The prosecution’s case is based on the testimony of a village watchman and the victim herself, who identified the petitioner as the shooter. The offences alleged include wrongful restraint (IPC s.341), voluntarily causing hurt (IPC s.323), attempt to murder (IPC s.307) and a violation of Section 27 of the Arms Act. The petitioner argued that he feared arrest, but the court examined the seriousness of the charges, the corroborative statements, and the gravity of the alleged crime. Finding the material on record sufficient to justify detention, the court rejected the pre‑arrest bail application.

Issues considered

  • Whether the petitioner is entitled to pre‑arrest bail in light of the alleged offences under IPC s.341, s.323, s.307 and Arms Act s.27
  • Whether the evidence on record, including the victim’s testimony, warrants denial of bail
