Patna High Court

NITESH KUMAR @ NITISH KUMARversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the allegations were general and omnibus, warranting the grant of bail to the petitioner.

Summary

The petitioner, Nitesh Kumar, was arrested in connection with a complaint alleging cruelty and dowry harassment under Sections 498A and 34 of the IPC and Section 4 of the Dowry Prohibition Act, demanding Rs.2 lakh and a four‑wheeler. The petitioner contended that the allegations were baseless, citing his filing of a restitution of conjugal rights petition and the complainant's failure to appear before the family court and mediation proceedings. The Additional Public Prosecutor opposed bail. The court observed that the dowry demand allegations were vague, general and omnibus, and noted the complainant’s non‑appearance. Consequently, the court ordered the petitioner’s release on bail with a bond of Rs.10,000 and two sureties, invoking Section 482(2) of the BNSS. The bail order was conditioned on compliance with the stipulated terms.

Issues considered

  • Whether the petitioner is entitled to bail despite pending charges under Sections 498A, 34 IPC and Section 4 D.P. Act.
  • Whether the allegations of dowry demand are sufficiently specific to deny bail.
  • Whether the complainant’s failure to appear before the court influences the grant of bail.
