Patna High Court

Sanjay Kumar SharmaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner with specified conditions.

Summary

The petitioner, Sanjay Kumar Sharma, feared arrest in a criminal case (CA No. 324 of 2023) alleging assault (IPC s.323) and dowry harassment (IPC s.498‑A). He applied for anticipatory bail, claiming innocence and false implication. The State opposed the application. Relying on the Supreme Court’s decision in Arnesh Kumar v. State of Bihar, the Patna High Court granted anticipatory bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and comply with conditions under Section 438(2) of the CrPC and Section 482. Additionally, the court ordered the petitioner to pay a monthly maintenance of Rs.12,000 to the informant, subject to any further maintenance orders. The order is effective for six weeks from the date of pronouncement.

Issues considered

  • What is the appropriateness of granting anticipatory bail to the petitioner under Section 438 of the CrPC in view of the allegations under IPC sections 323 and 498‑A?
