The court granted regular bail to each petitioner upon the condition of furnishing a Rs.10,000 bail bond with two sureties of the same amount.
Summary
The petitioners, a group of ten residents of Rani village, applied for regular bail in connection with PS Dinara case no. 364 of 2025, which is registered under several sections of the Bharatiya Nyaya Sanhita, 2023. The FIR alleges that 52 named and about 100 unknown persons attacked a police station, destroyed property, and that the petitioners were falsely implicated despite not being named in the FIR. The petitioners have been in custody since 17 October 2025, have no prior criminal record, and contend that the allegations against them are general and omnibus. The State opposed the bail, but the court noted that several co‑accused had already been released on bail and considered the petitioners' lack of specific charges and long pre‑trial detention. Consequently, the court ordered that each petitioner be released on bail upon furnishing a Rs.10,000 bond with two sureties of equal amount, subject to the satisfaction of the Additional Chief Judicial Magistrate, Bikramganj.
Issues considered
- Whether the petitioners, who are not named in the FIR, are entitled to regular bail despite the serious nature of the offences alleged against the accused group.
- Whether the length of pre‑trial detention and the absence of prior criminal antecedents justify granting bail.
- Whether the bail bond and surety conditions prescribed are appropriate under the Bharatiya Nyaya Sanhita.
