Patna High Court

Suraj Kumar @ Suraj Kumar DasversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, subject to bond and surety conditions.

Summary

Suraj Kumar applied for bail after learning that he may be arrested in connection with Mahindwara P.S. Case No. 154 of 2023, which alleges kidnapping and rape under IPC sections 363, 366(A), 376, as well as offences under the POCSO Act and the Immoral Traffic Act. The prosecution contends that the petitioner abducted and raped a minor, while the petitioner claims innocence, asserting that the alleged victim eloped with him to Punjab. The court examined the bail application, considering the seriousness of the charges and the petitioner’s claim of lack of culpability. It concluded that bail could be granted pending trial, subject to conditions. Accordingly, the court ordered the petitioner’s release on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to the provisions of Section 438(2) of the CrPC and Section 482 of the CrPC.

Issues considered

  • Whether bail should be granted to the petitioner in a case involving alleged kidnapping and rape of a minor.
  • Whether the allegations constitute sufficient grounds to deny bail under the CrPC.
