Patna High Court

RANI KUMARI @ RANI DEVIversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The Court denied bail, holding that the seriousness of the charges and the post‑mortem evidence warrant the petitioners' continued detention.

Summary

The petitioners, Rani Kumari, Anchal Kumari and Vishal Kumar, were charged under IPC sections 341, 323, 328, 307, 302 and 34 for allegedly administering poison to the son of an informant, resulting in his death. They applied for bail, claiming innocence, a clean antecedent and that the deceased had a history of alcoholism and suicidal tendencies. The prosecution presented a post‑mortem report confirming the presence of celphos (phosphorus) in the victim’s body, supporting the murder charge. The learned counsel for the State opposed bail, emphasizing the seriousness of the offences and the evidential material. The Court, after considering the gravity of the accusations and the forensic evidence, rejected the bail application.

                                       ORAL ORDER

7 02-02-2026 Heard learned counsel for the parties.
                                2. Petitioners apprehend arrest in a case registered for
                   the offence punishable under sections 341, 323, 328, 307,
                   302/34 of the IPC.
                                3. As per prosecution case, petitioner no.3 caught hold
of the deceased, petitioner no.1 brought poison from the house
and petitioner no.2 forcibly administered the poison in the
mouth of son of informant. Thereafter, all the accused persons
went away after locking informant’s son in the room. Anyhow,
he was taken to the hospital where he died during treatment.
                                4. Learned counsel appearing for the petitioners
submits that the petitioners are innocent and have falsely been
implicated in this case. As a matter of fact, deceased had
unstable family life and he was alcoholic and had developed
suicidal tendency leading to consuming poisonous substance.
                   Petitioners claim clean antecedent.

                                                         2/2

                                    5. Learned counsel for the State opposes the prayer
for bail. Post mortem report reveals that celphos was found in
                       the body of the deceased.
                                    6. Considering the nature and gravity of accusation,
prayer for bail of these petitioners is rejected.
