Holding

The Court denied bail to the petitioner.

Summary

Satish Kumar was arrested in July 2025 for alleged involvement in a 2017 robbery and shooting at his jewelry shop in Nawada, for which he is charged under IPC sections 396, 397, 398 and Section 27 of the Arms Act. The prosecution alleges that three assailants entered the shop, one fired a pistol injuring a brother who later died, and that CCTV footage and a co‑accused’s statement implicate the petitioner as the shooter. The petitioner contends he was falsely implicated, that the FIR was fabricated, and that his name was added only later from a confessional statement of another accused; he also points to a prior bail order granted to a co‑accused. The State opposed bail, relying on the co‑accused’s testimony and video evidence. The Court, considering the seriousness of the offences and the supporting evidence, refused the bail application.

Issues considered

  • Whether bail should be granted to the petitioner in a case involving robbery, dacoity, attempt to murder and illegal possession of arms, given the existence of CCTV footage and co‑accused testimony.
  • Whether the petitioner’s claim of false implication and a forged FIR warrants bail.

and the petitioner has not committed any offence as alleged in

the FIR. It is next submitted that initially the petitioner was not

named in the FIR and the name of the petitioner has transpired

on the confessional statement of Avinash Srivastav @ Amit @

Abhinash Shreevasta. Learned counsel for the petitioner further
