Decided

BAIL GRANTED

Holding

The prayer for anticipatory bail is allowed.

Summary

The petitioners, Rajan Kumar and Golu Kumar, sought anticipatory bail fearing arrest in a case alleging assault with an iron rod under several sections of the B.N.S. The prosecution alleged that the accused assaulted an informant, while the petitioners contended they were innocent, stating the incident was a minor scuffle at a liquor‑induced party and that the accusations were vague and omnibus. The State opposed the bail. The Court examined the general nature of the allegations and the lack of specific overt acts against the petitioners. Finding the accusations insufficiently specific and the backdrop indicative of a minor altercation, the Court allowed the anticipatory bail. Accordingly, the petitioners were directed to furnish a bail bond of Rs 10,000 with two sureties each, subject to conditions under Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted when the accusations are general and omnibus
  • Whether the alleged assault constitutes a cognizable offence warranting arrest
  • Whether the petitioners are likely to be arrested within the stipulated eight‑week period
