Decided
Disposal
BAIL REJECTED

Holding

The pre‑arrest bail application was denied.

Summary

The petitioner, Sachin Kumar, was implicated in a FIR alleging that he, along with co‑accused, lured the informant's son, seized his IDBI Bank passbook, ATM card and a registered SIM, and subsequently withdrew large sums of money from the informant's account. He was charged under sections 316(2), 318(4) and 3(5) of the Bihar Negotiable Instruments Act (BNS) and has a prior criminal antecedent. The petitioner applied for pre‑arrest bail, arguing that the allegations did not warrant detention. The Court examined the seriousness of the offences, the amount involved, and the petitioner’s criminal history. Considering the gravity of the accusations and the antecedent, the Court rejected the bail application. The order was delivered by Justice Prabhat Kumar Singh.
