Decided
Disposal
BAIL REJECTED

Holding

The Court held that bail could not be granted and dismissed the bail petition.

Summary

The petitioner, Subhash Kumar Mahto, was charged with offences under sections 323, 504, 506, 420, 468 and 406 of the Indian Penal Code for allegedly deceiving the complainant, opening multiple bank accounts in her name, retaining her ATM cards and passbooks, and jointly with co‑accused siphoning large sums of money. He applied for arrest bail, fearing imminent arrest. The prosecution opposed the bail, emphasizing the seriousness of the fraud‑related allegations and the risk of tampering with evidence. The Court examined the nature of the accusations, the gravity of the offences, and the potential for the petitioner to influence the investigation. Concluding that the circumstances did not warrant the grant of bail, the Court rejected the bail application. The petition for bail was therefore dismissed.
