BAIL GRANTED

Holding

The Court granted bail to the petitioners, directing them to furnish a bond of Rs.10,000 with two sureties each.

Summary

The petitioners, Adhiklal Das and Manjhiya Devi, applied for bail in a murder case (Session Trial No. 860 of 2025) arising from Bathnaha P.S. Case No. 41 of 2024, where the deceased Renu Devi was allegedly killed on 14.05.2024. The prosecution alleged that the accused used threats and subsequently caused the death, which was later found to be a hanging. The petitioners contended they were innocent, had no criminal antecedent, were merely the father‑in‑law and mother‑in‑law of the deceased, and had been falsely implicated. The State opposed the bail on the ground of the seriousness of the offences under Sections 302, 120(B) and 34 of the IPC. After hearing both sides, the Court found the petitioners’ arguments persuasive and ordered that they be released on bail upon furnishing a bond of Rs.10,000 with two sureties each.

Issues considered

  • Whether bail should be granted to the accused in a case involving murder and alleged criminal conspiracy under Sections 302, 120(B) and 34 of the IPC.
  • Whether the petitioners’ claim of innocence and lack of prior criminal record warrants bail despite the seriousness of the alleged offences.
