Patna High Court

Ramji BhagatversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to bail in the present case.

Summary

The petitioner, Ramji Bhagat, sought bail in a criminal case (K. Hat (Sahayak) P.S. Case No. 1351 of 2023) where he was accused under Sections 306 and 34 of the Indian Penal Code for alleged involvement in a suicide following a court marriage. The prosecution alleged that the deceased Nitish was threatened by the accused and subsequently committed suicide, implicating the petitioner as the father of one of the parties. The petitioner contended that he was falsely implicated, had no criminal antecedent, and that the allegations were vague and based solely on his familial relationship. The State opposed the bail, but the court noted the lack of specific evidence against the petitioner and the fact that a co‑accused had already been granted bail. Consequently, the court ordered the petitioner to be released on bail upon furnishing a bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the offences under Sections 306 and 34 IPC
  • Whether the allegations against the petitioner are sufficiently specific to deny bail
  • Whether the petitioner’s lack of criminal antecedent and the grant of bail to a co‑accused affect the bail decision

                   APP for the State.

                                2. The petitioner has prayed for bail in connection with

                   K. Hat (Sahayak) P.S. Case No. 1351 of 2023 registered for the

offence punishable under Section 306 and 34 of the Indian Penal

                   Code.

                                3. The case of the prosecution is that Rohit and Shweta

solemnized marriage and the same was court marriage. It is

alleged that the deceased Nitish helped them in solemnizing

marriage. It is further alleged that he was being threatened by the

accused persons due to which, he committed suicide.

                                4. Learned counsel appearing on behalf of the petitioner

has submitted that petitioner is innocent and has committed no

offence. He has been falsely implicated in this case. He also

submits that the nature of allegation is general and omnibus. From
Patna High Court CR. MISC. No.6231 of 2026(2) dt.06-02-2026

perusal of the order of the learned trial court, it transpires that the

name of this petitioner has been maliciously dragged into this case

solely on account of his relationship as the father of Sweta

Kumari, within whom the friend of the deceased had solemnized

marriage. He also submits that co-accused namely, Sudhanshu

Bhagat has already been granted bail by this court vide Cr. Misc.

No. 82081 of 2025. He further submits that a statement has been

made in para 3 of the petition that petitioner has no criminal

antecedent and he is languishing in judicial custody since

                     17.11.2025.

                                  5. The application for bail is opposed by learned APP

                     for the State.

                                  6. Having heard learned counsel for the parties and

considering the facts and circumstances of the case, this Court is

inclined to enlarge the petitioner on bail. The above named

petitioner is directed to be enlarged on bail on furnishing bail

bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of

the like amount each to the satisfaction of the learned Chief

Judicial Magistrate, Purnea in connection with K. Hat (Sahayak)
