Patna High Court

Arjun KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that the petitioner is entitled to regular bail in the NDPS case.

Summary

Arjun Kumar was arrested in connection with a case under sections 8 and 20(b)(ii)(C) of the NDPS Act, where 22.57 kg of ganja was seized and 12.345 kg was alleged to have been recovered from his possession. The petitioner contended that he was falsely implicated, that no narcotic article was actually found on him and that the seized packet belonged to another passenger, and he had no prior NDPS record. He had been in custody since 17 October 2025 and filed an application for regular bail. The State opposed the bail, but the Court, noting the lack of antecedent, the questionable recovery, and the fact that a charge‑sheet had already been filed, ordered that the petitioner be released on bail upon furnishing a bond of Rs.10,000 with two sureties. The bail order was directed to be satisfied to the Sessions Judge‑cum‑Special Judge of the NDPS Act in Kishanganj.

Issues considered

  • Whether the petitioner is entitled to regular bail under sections 8 and 20(b)(ii)(C) of the NDPS Act given the circumstances of alleged false implication and lack of incriminating article in his possession.
  • Whether the absence of prior NDPS antecedents and the fact that the charge‑sheet has been filed justify the grant of bail.
