The Court rejected the anticipatory bail application and allowed the petitioner to withdraw the petition with liberty to surrender.
Summary
Munna Yadav filed an anticipatory bail petition fearing arrest in a criminal case (PS Dharhara Case No.130 of 2025) under sections 103(1) and 3(5) of the Bihar Narcotic Substances Act. While arguing before the Patna High Court, he later requested to withdraw the anticipatory bail petition and sought liberty to surrender and apply for regular bail. The Court, after hearing both sides, allowed the withdrawal and granted him liberty to surrender, thereby rejecting the anticipatory bail application. No substantive discussion on the merits of the bail request was recorded. The petition was consequently disposed.
