Holding

Anticipatory bail is denied to the petitioner.

Summary

The petitioner, Rajnish Kumar Paswan, applied for anticipatory bail fearing arrest in a murder‑related case (Kudra P.S. Case No. 273 of 2025) involving alleged participation in a supari killing. The prosecution alleged offences under Sections 109(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. The High Court noted the gravity of the alleged crime and the fact that a co‑accused’s regular bail had already been denied. Consequently, the Court declined to grant anticipatory bail, directing the petitioner to surrender within a week and seek regular bail, failing which the police would arrest him. The order was limited to the present application and does not prejudice any future proceedings.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the Bharatiya Nyaya Sanhita, 2023 and the Arms Act in view of the alleged involvement in a supari killing.
