Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied as the offences were serious and the petitioner had a criminal antecedent.

Summary

The petitioner, Deepak Kumar Yadav, applied for anticipatory bail fearing arrest in a robbery‑and‑assault case (PS‑464/2025) involving alleged snatching of Rs 3,200 and assault with an iron rod. The prosecution alleged that the petitioner, along with unknown accomplices, intercepted the victim on a motorcycle, stole the money and caused a head injury classified as grievous by a medical report. The State highlighted the petitioner’s prior criminal antecedents. The court examined the seriousness of the offences under sections 126(2), 115(2), 109 and 303(2) of the BNS and the presence of a grievous injury, concluding that the criteria for anticipatory bail were not met. Consequently, the anticipatory bail application was rejected.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in view of the alleged robbery, assault and grievous injury.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of anticipatory bail.
