BAIL GRANTED

Holding

The court held that the petitioner is entitled to bail as the three‑month period has elapsed and he fulfills the bail conditions.

Summary

The petitioner, Balle (also known as Md. Suhel), was arrested in connection with Sessions Trial No. 1283 of 2025 arising from PS Vishnupad Case No. 146 of 2024. He filed a bail petition which was rejected by the Patna High Court on 29 August 2025, with the court directing that he could renew his application after three months. On 16 February 2026, the petitioner renewed his bail prayer, contending that the three‑month period had elapsed. The court examined whether the statutory period for renewal had indeed passed and whether the petitioner satisfied the conditions for bail. Finding that the stipulated period was complete and that the petitioner could provide the required bail bond and sureties, the court ordered his release on bail. The bail was conditioned on a bond of Rs.10,000, two sureties of equal amount, and the petitioner’s cooperation with the trial proceedings.
