Patna High Court

Shyam Narayan Singh @ Shyam Narain SinghversusThe State Of Bihar

Decided
Disposal
DISMISSED

Holding

The court denied bail, holding that there was no merit to enlarge bail at this advanced stage of the trial.

Summary

The petitioner, Shyam Narayan Singh, sought regular bail in a case registered under Sections 364, 120-B, 302 and 210 of the Indian Penal Code. The trial court had completed the prosecution evidence and the accused's Section 313 examination, and was awaiting defence evidence, which the defence had already exhausted without producing any. The High Court noted that the trial was at its final stage and found no merit in granting bail at this point. The court directed the petitioner's counsel to cooperate with the trial court for speedy conclusion. Consequently, the court rejected the petitioner's bail application.

Issues considered

  • Whether regular bail should be granted to the accused at the final stage of trial where prosecution evidence is complete and defence evidence has been exhausted.

concluded expeditiously with this observation that I do not find

any merit in this case as the trial is on its fag end.
