Patna High Court

Sipahi PrasadversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petition for anticipatory bail is allowed, subject to specified conditions.

Summary

Sipahi Prasad sought anticipatory bail after being implicated in Barharia P.S. Case No. 511 of 2025 for alleged assault on an informant under Sections 126(2), 115(2), 109, 351(3), 352 and 3(5) of the B.N.S. The prosecution alleged that the petitioner assaulted the informant, while the petitioner contended that the allegations were fabricated and that the injury report showed only a simple injury caused by a blunt object. The petitioner also highlighted his clean antecedent. The State opposed the bail application. The High Court, after considering the submissions and the injury report, granted anticipatory bail under Section 438(2) of the CrPC and Section 482(2) of the B.N.S.S., imposing conditions such as a bail bond of Rs.10,000 with two sureties, personal appearance in court, and provisions for cancellation on non‑compliance or future similar offences. The order clarified that any observations made would not affect the trial.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC.
  • Whether the allegations of assault are substantiated enough to deny bail.
  • Whether the petitioner’s clean antecedent warrants bail.
