Patna High Court

Ashok MandalversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that bail could not be granted and dismissed the regular bail application.

Summary

Ashok Mandal was charged with kidnapping for ransom under Sections 364, 364A and 34 of the Indian Penal Code. The petitioner had been in custody since May 19, 2023 and earlier bail applications were rejected by the Patna High Court. He filed a fresh regular bail application, arguing that the trial had commenced and only one witness had been examined. The court considered the gravity of the offence and the fact that the trial was already underway, and declined to revisit its earlier orders. Consequently, the bail application was dismissed and the Superintendent of Police was directed to ensure witness attendance in the ongoing trial.

Issues considered

  • Whether the petitioner is entitled to regular bail in a kidnapping for ransom case under Sections 364, 364A and 34 of the IPC, given that the trial has commenced and the offence is serious.
