Decided
Disposal
REJECTED

Holding

The court held that bail could not be granted as the case was at an advanced stage with prosecution evidence already closed.

Summary

The petitioner, Hiralal Yadav, was charged under sections 302, 147, 148, 149, 323 and 504 of the IPC and section 27 of the Arms Act for allegedly firing on an informant's brother, resulting in death. He applied for bail while the trial was at an advanced stage, with all charge‑sheet witnesses examined and prosecution evidence closed, and the next hearing scheduled for recording his statement under Section 313 Cr.P.C. The State opposed the bail. The Patna High Court, noting the advanced stage of the proceedings and the seriousness of the offences, declined to grant bail. Consequently, the bail application was rejected.
