The court granted anticipatory bail to the petitioner under Section 438(2) of the CrPC.
Summary
The petitioner, Abhay Kumar, sought anticipatory bail after a complaint was lodged by his mother‑in‑law, Shanti Devi, alleging dowry demands and harassment under Sections 498A and 34 of the IPC and Section 4 of the Dowry Prohibition Act. The prosecution alleged that the petitioner and others demanded Rs.5 lakh, a motorcycle and a gold chain, and that the complainant’s daughter was tortured for non‑payment. The petitioner contended he was innocent, that the daughter had left him, and that he was already paying a court‑ordered maintenance of Rs.2,000 as directed by a Delhi court. The court noted the maintenance payment and the fact that the mother‑in‑law, not the wife, filed the complaint, and observed that the opposite party did not appear despite service of notice. Consequently, the court granted anticipatory bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties if arrested within four weeks, subject to conditions under Section 438(2) of the CrPC.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 438 of the CrPC in a case involving alleged dowry harassment under Sections 498A, 34 IPC and Section 4 of the Dowry Prohibition Act.
- Whether the complaint filed by the mother‑in‑law, rather than the wife, suffices to sustain the charges.
