Patna High Court

Purushottam KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The court held that pre‑arrest bail could not be granted due to the seriousness of the allegations and the risk of interference with the investigation.

Summary

The petitioner, Purushottam Kumar, was implicated in a criminal complaint alleging that he and co‑accused sold a brick kiln to an informant for Rs 8,11,000 and subsequently prevented the informant from operating the kiln and refused to return the money. The prosecution charged him under sections 318(1), 318(4) and 351(2) of the Bihar Negotiable Instruments Act. The petitioner applied for pre‑arrest bail, fearing imminent arrest. The court examined the nature and gravity of the allegations, noting that the offences involved a substantial financial loss and a serious breach of trust. Considering these factors, the court concluded that granting bail at this stage would be inappropriate. Consequently, the application for pre‑arrest bail was rejected.
