Patna High Court

Suresh Nat @ Lamboo NatversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner.

Summary

The petitioner, Suresh Nat, was implicated in a case (Thawe P.S. Case No. 11 of 2024) for offences under Sections 399 and 402 of the Indian Penal Code and Sections 25(1‑b)a, 26 and 35 of the Arms Act after a police raid recovered a pistol from a co‑accused but nothing from him. He contended that he was falsely implicated and pointed out that a co‑accused, Raju Kumar, had already been granted bail, suggesting his case was on a stronger footing. The State opposed the bail application. The Court examined the facts, noting the lack of incriminating material against the petitioner, and decided to grant regular bail on the condition of a Rs.10,000 bond with two sureties and compliance with trial requirements. The order was pronounced by Justice Nawneet Kumar Pandey.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged under serious IPC offences and the Arms Act.
