Patna High Court

Suresh GaddiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the bail application and ordered the petitioner’s release on bail.

Summary

The petitioner, Suresh Gaddi, was arrested on 24 July 2024 in connection with a police case registered under multiple sections of the Bihar Narcotic Substances Act, 2023. He had previously applied for bail, which was denied by the Patna High Court on 22 January 2025. In a second bail application, the petitioner produced a photocopy of a compromise petition and sought release. The Court examined the compromise petition and the circumstances of his custody and decided to grant bail. Accordingly, the petitioner was ordered to furnish a bail bond of Rs.10,000 with two sureties and to appear weekly at Gopalpur Police Station, with non‑appearance leading to cancellation of bail.

Issues considered

  • Whether the petitioner is entitled to bail despite the earlier denial of his bail application.
  • Whether the production of a compromise petition suffices to justify the grant of bail.
  • Whether the conditions imposed by the Court are appropriate under the Bihar Narcotic Substances Act, 2023.
