Patna High Court

Nitesh Kumar @ Nitish KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner.

Summary

The petitioner, Nitesh Kumar, was accused in a police case of kidnapping a minor girl for the purpose of marriage and allegedly stealing Rs. 50,000. The prosecution relied on Sections 137(2), 96 and 3(5) of the Bihar Naxal Suppression Act, 2023. The petitioner contended that the allegations were fabricated and pointed to the victim's statement recorded under Section 183 of the same Act, in which she denied the prosecution's version and said she left home to avoid an arranged marriage. The High Court, after considering the victim's statement, found insufficient basis to deny bail and exercised its powers under Section 438(2) of the Criminal Procedure Code and Section 482(2) of the BNSS, 2023 to grant anticipatory bail. The court ordered the petitioner to furnish a bail bond of Rs. 10,000 with two sureties if arrested within four weeks, thereby allowing the application.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 of the CrPC in view of the allegations under the BNSS, 2023.
  • Whether the victim's statement under Section 183 of the BNSS, 2023 negates the prosecution's case.
