Summary
Petitioner Rajesh Kumar Singh filed a criminal miscellaneous petition against the State of Bihar and Bhanu Pratap Singh. He sought to withdraw the pending proceedings so that he could present his arguments at the appropriate stage of charge framing by filing a discharge application. The learned counsel for the petitioner made this request before the Hon'ble Justice Smt. Soni Shrivastava. The court considered whether such a withdrawal was permissible. It held that the petitioner could withdraw the case and was granted liberty to raise his arguments when the charge is framed.
