Patna High Court

Satyendra KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court denied bail to the petitioner, dismissing the application.

Summary

The petitioner, Satyendra Kumar, was arrested in connection with a case registered under Sections 406, 420 and 379 of the Indian Penal Code for allegedly taking a hired truck that later disappeared. He contended that he was falsely implicated and offered to cooperate with the investigation, having been in custody since 4 March 2025. The State opposed his bail application, highlighting his alleged involvement in 79 similar cases, indicating a pattern of cheating. The court considered the seriousness of the offences and the petitioner’s criminal antecedents. Concluding that the allegations and prior record warranted continued detention, the court dismissed the bail application and ordered the Senior Superintendent of Police to examine the case records and ensure trial. The decision reflects the court’s discretion to deny bail where the risk of reoffending or tampering with evidence is perceived to be high.
