Patna High Court

Randhir Kumar @ ParasversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner subject to bond and conditions.

Summary

The petitioner, Randhir Kumar, was arrested in connection with a robbery alleged under Section 309(4) of the BNS. He claimed innocence, stating that his name appeared only in a co‑accused’s confessional statement and that the money recovered was his own. He had been in custody since 10 March 2025 without any TIP being conducted, while the co‑accused had already been granted bail. The State opposed bail, but the court considered the length of incarceration and the lack of investigative progress. Justice Nawneet Kumar Pandey ordered the petitioner’s release on regular bail upon furnishing a Rs.10,000 bond with two sureties, subject to cooperation with the trial and verification of any other criminal antecedents. The bail was conditioned on the petitioner’s availability to the court.

Issues considered

  • Whether the petitioner is entitled to regular bail under Section 309(4) of the BNS despite the allegations and the co‑accused’s confessional statement.
  • Whether the prolonged pre‑trial detention without a TIP justifies bail.
