Holding

The court granted bail to the petitioner.

Summary

Durgesh Lal Harijan was arrested in a kidnapping case (IPC §§363, 366, 34) arising from a 2020 incident in Kishanganj. The prosecution alleged that the petitioner, along with others, abducted the wife of an informant and her minor daughter, while the victim’s statements under CrPC §§161 and 164 were contradictory regarding whether she was enticed or forcefully kidnapped. The petitioner argued that he was falsely implicated, highlighted a sixteen‑day delay between the alleged occurrence and the FIR, and pointed to the lack of criminal antecedents and the fact that co‑accused had been granted bail in a similar case. The State opposed bail, citing the seriousness of the offences. After considering the facts, the court decided to enlarge bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the accused in a kidnapping case despite contradictory victim statements and delay in filing the FIR
  • Whether the precedent of bail granted to co‑accused in a similar case warrants bail in the present case
