Patna High Court

Randhir Kumar @ Raja @ Randheer KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner because the charge‑sheet had been filed, he had a clean antecedent and a compromise had been reached.

Summary

The petitioner, Randhir Kumar, was arrested in connection with a case alleging kidnapping, criminal intimidation, wrongful confinement and criminal conspiracy under Sections 363, 366(A), 504 and 120(B) r/w 34 of the IPC. The prosecution alleged that the petitioner and co‑accused enticed a 15‑year‑old girl with the intention of solemnising a marriage, after which the girl went missing. The petitioner claimed innocence, stating that the girl was in love with him, that they later married and have a child, and that the matter was settled amicably with a compromise petition filed in the trial court. The State opposed bail, but the court noted the filing of the charge‑sheet, the petitioner’s clean antecedent, the delay in lodging the FIR and the existence of a compromise. Accordingly, the court granted bail subject to a bond of Rs.10,000 with two sureties and conditions under Section 480(3) of the BNSS. The petitioner was ordered to be released on bail.

Issues considered

  • Whether the petitioner is entitled to bail in offences punishable under Sections 363, 366(A), 504 and 120(B) r/w 34 of the IPC.
  • Whether the existence of a compromise petition and the petitioner’s clean antecedent justify granting bail.
