Patna High Court

Ravi Shankar Kumar @ Ravi Kumar @ Ravi YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed the bail application, granting bail subject to specified conditions.

Summary

The petitioner, Ravi Shankar Kumar, was arrested on 8 January 2025 for allegedly looting two mobile phones and Rs.31,500, charged under Section 392 of the Indian Penal Code. He had been in custody for several months after his earlier bail application was rejected on 12 May 2025. The petitioner sought bail again, arguing that co-accused persons had already been released on bail. The court considered the length of custody, the nature of the offence, and the fact that other co-accused were on bail, and decided to grant bail. The bail was conditioned on a bond of Rs.10,000 with two sureties who must be blood relatives, regular attendance at the police station every Sunday, and cooperation with the trial proceedings. Non‑compliance with these conditions would lead to cancellation of the bail.

Issues considered

  • Whether bail should be granted to the petitioner charged under Section 392 IPC after a prolonged period of custody
  • Whether the grant of bail to co‑accused persons influences the petitioner's right to bail
  • Whether the conditions imposed are reasonable and sufficient to ensure the petitioner's attendance in court
