Holding

The court denied bail to the petitioner.

Summary

The petitioner, Anshu Kumar, applied for regular bail in a case registered under sections 80, 61(2) and 3(5) of the Bihar Narcotic Substances Act, 2023, alleging involvement in the murder of an informant's daughter. He has been in custody since August 13, 2024, and the post‑mortem report shows extensive injuries on the deceased. The primary issue before the court was whether bail should be granted given the seriousness of the alleged offence. The court noted the gravity of the charges and the evidence of severe injuries, concluding that bail was not appropriate. Consequently, the bail application was rejected, with the court emphasizing that no judgment on the merits of the case was made.
