Patna High Court

Arun Kumar @ Arun RamversusThe State of Bihar

Decided
Disposal
REJECTED

Holding

Bail was denied to the petitioner.

Summary

Arun Kumar was arrested on 5 August 2025 in connection with a 2024 FIR alleging offences under Sections 103(1), 80, 238 and 3(5) of the Bihar Narcotic Substances Act, 2023, including alleged dowry harassment and disposal of a dead body. The prosecution contended that after marrying the informant’s daughter, the petitioner demanded dowry and threatened a second marriage, and later, with co‑accused, disposed of the deceased’s body, which has not yet been recovered. The petitioner’s counsel argued that he has a clean antecedent, the FIR is fabricated, and he is being implicated merely as the husband of the deceased. The State opposed bail, emphasizing the seriousness of the alleged murder and body disposal. Justice Rajesh Kumar Verma, after considering the facts, refused the bail application, holding that the petitioner’s alleged involvement in disposing of the body warrants continued custody. The prayer for bail was therefore dismissed.

petitioner has clean antecedent and the allegation as alleged in

the F.I.R. is false and fabricated and the petitioner has not

committed any offence as alleged in the F.I.R. and he has been

made accused merely on the ground that he is husband of the

                      deceased.

                                   5. Learned APP for the State has vehemently opposed

the prayer for bail of the petitioner and submits that the

petitioner and other co-accused persons after committing crime

in question, disposed of the dead body of the deceased.

                                   6. Considering the aforesaid facts and circumstances

of the case and also considering the fact that petitioner with the

not been traced as yet, I am not inclined to enlarge the petitioner

on bail in connection with Tariyani P.S. Case No. 135 of 2024,
