The court denied anticipatory bail to the petitioner.
Summary
The petitioner, Ranju Yadav, sought anticipatory bail after being named in an FIR alleging his participation, along with others, in a masked attack on a bus that resulted in the death of the driver. The prosecution alleged that the accused fired upon the bus, citing statements from the bus manager, conductor, and a crew member who fled, as well as mobile tower data placing the petitioner at the scene. The petitioner claimed innocence and argued that the accusation was based merely on suspicion. The State and the informant opposed bail, emphasizing the specific accusations, supporting witness testimony, the petitioner’s mobile location evidence, and his three prior criminal convictions. The court, after considering the direct nature of the allegations, the investigative material, and the petitioner’s antecedents, rejected the prayer for anticipatory bail.
Issues considered
- Whether anticipatory bail should be granted to the petitioner given the specific accusations under Sections 103 and 3(5) of the B.N.S. and Section 27 of the Arms Act, the evidentiary material, and his criminal antecedents.
