Decided

BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to specified conditions.

Summary

Raju Das, arrested on 25 June 2025 in connection with a rape and alleged poisoning case (PS Dalsinghsarai Case No. 246 of 2024), sought bail. The FIR alleged offences under Sections 76, 115(2), 109, 123, 3(5), 238 of the Bharatiya Nyay Sanhita, 2023 and Sections 8 and 12 of the POCSO Act. The petitioner claimed a clean antecedent and that the allegations were fabricated, noting that a co‑accused had previously been granted bail by the same bench. The Additional Public Prosecutor opposed bail. The Court, considering the similar bail granted to the co‑accused and the petitioner's circumstances, ordered bail on a Rs.10,000 bond with two sureties and imposed conditions regarding court attendance, non‑tampering with evidence, and verification of criminal antecedents.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences under the Bharatiya Nyay Sanhita and the POCSO Act.
  • Whether the grant of bail to a co‑accused on similar charges warrants a similar relief for the petitioner.
