Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to bail under Section 438(2) of the CrPC and Section 482 of the BNSS.

Summary

Mukesh Singh, a tractor driver, feared arrest in a sand‑theft case (Jamui P.S. Case No. 647 of 2023) involving offences under Sections 420, 467, 468, 471, 182, 211, 353 and 120B of the IPC. He contended that he had no knowledge of the illegal sand transport and that the other co‑accused had already been granted bail. The court considered the nature of the allegations and the fact that co‑accused were on bail, and allowed his bail application. The court ordered his release on a bail bond of Rs. 10,000 with two sureties, subject to the conditions of Section 438(2) of the CrPC and Section 482 of the BNSS. The order was pronounced by Justice Sandeep Kumar.

Issues considered

  • Whether the petitioner, as a driver with alleged lack of knowledge, is entitled to bail in the pending case.
  • Whether the grant of bail to co‑accused influences the bail decision for the petitioner.
