Patna High Court

Avinash Kumar @ Jim @ Abhinash KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Regular bail was granted to the petitioner.

Summary

The petitioner, Avinash Kumar, was arrested in connection with a case registered under Sections 341, 323, 324, 307 and 34 of the Indian Penal Code, alleging that he, along with co‑accused, inflicted knife wounds on Rohit Kumar. The petitioner claimed innocence, stating that the alleged principal assailant Rohit Kumar had already been granted bail and that he was falsely implicated. The State opposed the bail application. After hearing both sides, the court considered the petitioner's custody since 18‑07‑2025, the lack of direct evidence against him, and the bail already granted to the co‑accused. The court ordered that the petitioner be released on regular bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions of cooperation and availability for trial.

Issues considered

  • Whether the petitioner is entitled to regular bail in a case involving offences under Sections 341, 323, 324, 307 and 34 of the IPC.
