Patna High Court

Suraj Kumar SahversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on the condition of furnishing a bond and sureties.

Summary

The petitioner, Suraj Kumar Sah, was arrested after police recovered 15 litres of syrup from his motorcycle in a case under Sections 21 and 22 of the NDPS Act. A raid on the co-accused's house yielded codeine cough syrup, 384 Symdex Plus tablets and 300 Nitrazepam tablets; the co-accused had already been granted bail. The petitioner, who had been in custody for over six months, claimed innocence and sought bail. The State opposed the bail application. Considering the length of pre‑trial detention, the bail granted to the co‑accused, and the circumstances of the case, the court ordered the petitioner’s release on bail with a bond of Rs.10,000 and two sureties, subject to appearing before the trial court until charges are framed.

Issues considered

  • Whether bail should be granted to the accused in a case under Sections 21 and 22 of the NDPS Act despite the seriousness of the alleged offence.
  • Whether the prolonged pre‑trial detention and the bail granted to a co‑accused justify granting bail to the petitioner.
