Patna High Court

Rahul Kumar Singh @ Rahul SinghversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Bail was denied because of the specific and direct nature of the accusation, the gravity of the offences, and the petitioner’s criminal antecedent.

Summary

The petitioner, Rahul Kumar Singh, applied for bail in a case registered under Sections 302, 504 and 34 of the Indian Penal Code, alleging that he was falsely implicated and has been in custody since 30 July 2024. The State and the informant opposed the bail, contending that the petitioner is specifically accused of assaulting the informant's father, leading to death, and that he has a prior criminal record. The court examined the seriousness of the charges, the direct nature of the accusation, and the petitioner’s antecedent. Considering these factors, the court rejected the bail application. Additionally, the trial court was directed to expedite the trial and aim to conclude it within one year of receiving the order.

Issues considered

  • Whether bail should be granted to the petitioner accused of murder, assault and common intention under Sections 302, 504 and 34 IPC.
  • Whether the petitioner’s claim of false implication merits bail.
  • Whether the trial should be expedited given the prolonged pre‑trial custody.
