The petitioner is entitled to bail on condition of a Rs.10,000 bond with two sureties.

Summary

Petitioner Bharat Kumar was arrested in Alauli P.S. Case No. 405 of 2025 for alleged offences under several sections of the B.N.S. and Section 27 of the Arms Act, accused of participating in an armed robbery demanding Rs.2 lakh and firing indiscriminately, with Bhushan Yadav specifically alleged to have shot an informant. The petitioner contended that he was falsely implicated, that the FIR specifically named only Bhushan Yadav, and that the informant suffered only minor injury, while he had been in judicial custody since 5 October 2025. The State opposed bail, citing the petitioner’s two prior criminal cases. The Court examined the allegations, the lack of specific charge against the petitioner, and the circumstances of his detention, and found merit in the petitioner's claim of false implication. Consequently, the Court ordered that the petitioner be released on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to the satisfaction of the learned Chief Judicial Magistrate, Khagaria.

considering the facts and circumstances of the case, this Court is

inclined to enlarge the petitioner on bail. The above named
