Patna High Court

Ravi Kumar @ Sanjiv KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court ordered the release of the petitioner on regular bail subject to a bond and sureties.

Summary

Petitioner Ravi Kumar was arrested in connection with a case alleging kidnapping of a minor, forced marriage, and filming of the act, under several sections of the Bihar Penal Code. The informant, the victim’s mother, claimed the kidnapping and forced marriage were carried out by the petitioner and three co‑accused, with the main allegation directed at co‑accused Sonu Kumar. The petitioner pleaded innocence, arguing he is a villager falsely implicated and has a clean record, and sought regular bail. The State and the informant opposed bail, citing the seriousness of the offences. Considering the custody period, the primary allegation against Sonu Kumar, and the petitioner’s cooperation, the court granted regular bail on a bond of Rs 10,000 with two sureties, subject to conditions of cooperation and availability for trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the offences alleged under sections 87, 137, 126(2), 115(2), 352 and 351(2) of the Bihar Penal Code.
  • Whether the evidence, particularly the victim’s statement under Section 183, justifies continued detention of the petitioner.
  • Whether the fact that the main allegation is against a co‑accused affects the bail eligibility of the petitioner.
