DISMISSED

Holding

The Court found no illegality in the maintenance order and dismissed the petition to quash it.

Summary

The petitioner, Shambhu Kumar, filed an application seeking to quash a maintenance order of Rs.10,000 per month dated 2 May 2016, which was affirmed by the Additional Sessions Judge. The High Court examined the order and found no illegality, noting that the petitioner, as the husband of the respondent, had not paid the maintenance. Consequently, the Court dismissed the petition and directed the petitioner to calculate arrears at Rs.5,000 per month from May 2016 to January 2026 and pay the amount to the respondent. The Court further instructed that, after payment, the petitioner may apply for modification of the maintenance under Section 127 of the Cr.P.C. or Section 146 of the BNSS; otherwise, he must pay Rs.10,000 per month from February 2026 onward. A warning was issued that failure to comply within a month would invite coercive action by the lower court.
