Patna High Court

Mantun PanditversusThe State of Bihar

Decided

Holding

The court granted regular bail to the petitioner.

Summary

Mantun Pandit was arrested for alleged extortion, assault and intimidation under Sections 126(2), 115(2), 109 and 3(5) of the BNS. The petitioner sought regular bail, arguing that the FIR was vague, the allegations against him were general, the parties had reached a compromise, and he had no prior criminal record, having been in custody since 16‑12‑2025. The State opposed the bail application. After hearing both sides, the Patna High Court found the circumstances sufficient to grant bail, directing the petitioner to be released on a bail bond of Rs.10,000 with two sureties of the same amount, subject to the satisfaction of the Chief Judicial Magistrate, Khagaria.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the offences alleged under the BNS
  • Whether the vagueness of the FIR and the existence of a compromise affect the bail decision
  • Whether the petitioner’s clean antecedent and period of custody justify bail

2 10-02-2026 Heard learned counsel for the petitioner and learned

                   APP for the State.

                                2. The petitioner has prayed for regular bail in a case

registered for the offence punishable under Sections 126(2),

                   115(2), 109 & 3(5) of the BNS.

                                3. The case of the prosecution, in short, is that the

petitioner along with others arrived at the house of the informant

and demanded extortion by pointing pistol and when the

informant refused for extortion, then the petitioner and others

started assaulting the informant and his family and abused them.

                                4. Learned counsel for the petitioner submits that

from perusal of the FIR itself it is clear that no specific

allegation against the petitioner and the nature of allegation is

general and omnibus. Learned counsel for the petitioner has

further submitted that parties have compromised and there is

also a counter version of this case. Learned counsel for the

petitioner has lastly submitted that the petitioner is having no

criminal antecedent and he is in judicial custody since

                      16.12.2025.

                                   5. Learned APP appearing for the State has

vehemently opposed the prayer of regular bail.

                                   6. Having heard learned counsel for the parties and

considering the facts and circumstances of the case, this court is

inclined to enlarge the petitioner on bail. The above named

petitioner is directed to be released on bail in connection with

Alauli P.S. Case No. 487 of 2025 on furnishing bail bond of

Rs.10,000/- (ten thousand) with two sureties of the like amount

each to the satisfaction of learned Chief Judicial Magistrate,

                      Khagaria.
